VII. SHOPPING PROCEDURES

7.1 Product Characteristics

The Barclay Studio has made an effort to show the colors of the products as close to reality as possible. However, the color of the product that appears on the screen of your device may be subject to variations depending on its quality or type. In this sense, The Barclay Studio cannot guarantee that the colors that appear on the screen of your device will be faithful to reality.

In addition, the characteristics of the natural materials used in the manufacture of some of the products may present variations in texture and color. These variations will not be considered quality defects or defects.

Additionally, The Barclay Studio makes the necessary efforts so that the information contained on the WEBSITE is complete, truthful, and correct. If there is an error in any information, The Barclay Studio will rectify it.

7.2 Purchase Procedure

The Products ordered remain the property of THE BARCLAY STUDIO until full payment has been received by THE BARCLAY STUDIO.

  • A. The items to be purchased must be selected and added to the shopping bag by clicking on the corresponding icon.
  • B. The shopping bag will contain the reference of the selected item, its name, size, chosen color, and price, in the corresponding currency (taxes included). The price expressed does not include transportation, whose rates will vary depending on the selected shipping method.
  • C. To make the purchase, the customer’s personal data will be required, which will be incorporated into our database in order to process the order and, where appropriate, facilitate the making of new purchases through the WEBSITE. The personal data provided by customers will be treated in accordance with the provisions of our Privacy Policy. The client will be able to access, at any time, the personal data provided and the information of the orders placed. The Barclay Studio reminds customers that personal data must be indicated accurately to avoid confusion or incidents in the shipment of the item (s) purchased. In addition, the client, in the case of being expressly requested by him, will receive by email and / or SMS personalized commercial communications adapted to his profile.
  • D. Before placing the order, a summary of the order will be presented to the client, identifying the product (s) added in the shopping bag, its total price (transport and taxes included) with each of the items broken down, and the shipping data of the order, so that the client confirms it by clicking on the button with the expression ‘Confirm payment’.
  • E. If, before confirming the payment, you detect an error in your order, you can modify any detail thereof by clicking on the “Edit” or “Delete” button. 7.3 Product Availability

All orders are subject to the availability of the products. Our offers of products and prices are valid as long as they are visible on the WEBSITE, within the limits of available stocks. Errors or modifications may exceptionally occur, particularly in the case of simultaneous orders of the same Product by several customers. If at the time the order is issued, the product is no longer available, The Barclay Studio will try to locate the product by other means that may be within its reach. If it is not possible to have such availability, the client will be notified immediately. In addition, the amount of the item charged and not sent will be paid to the customer in the following days, by the same means of payment used in the purchase.

The Barclay Studio shall not be held liable in the event of stock shortages or unavailability of Products for orders not yet accepted by The Barclay Studio.

The Barclay Studio reserves the right to change at any time and without notice, the products offered on the WEBSITE. In order to ensure a better quality of service and availability of our products to all customers of the WEBSITE, The Barclay Studio reserves the right to limit the number of products that can be purchased by a customer, in accordance with the provisions applicable in this respect.

7.4 The right not to accept an order

The Barclay Studio may cancel any Confirmed order or not accept an order placed for the following reasons:

  1. In the event of a technical error and/or a typographical error in the prices or in the rest of the data of the products contained in the WEBSITE when the order was placed.
  2. Due to lack of availability as described in the previous point.
  3. When the security systems indicate that the order may be fraudulent.
  4. When there are reasons that indicate that the client is a minor.
  5. When The Barclay Studio has not been able to deliver the order to the address provided by the customer.
  6. When there is a computer attack, virus, or any event that is beyond the reasonable control (force majeure) of The Barclay Studio.

VIII. PRICE AND PAYMENT METHOD

8.1 Payment Methods

The Barclay Studio will only accept payments made through the WEBSITE with the following credit or debit cards: Visa, Visa Electron, MasterCard, and American Express.

In the event that the payment method chosen by the client is a credit or debit card, the charge will be made online, that is, in real-time, through the payment gateway of the corresponding financial institution, once it has been verified that the data communicated is correct.

8.2. Payment Security

In order to provide maximum security to the payment system, The Barclay Studio uses secure payment systems from leading financial institutions in electronic commerce. In this sense, the confidential data of the payment are transmitted directly and in an encrypted form (SSL) to the corresponding financial institution. For payment with Visa, MasterCard, and American Express cards,The Barclay Studio only accepts CES (Secure Electronic Commerce) transactions including, if applicable, the international 3D Secure protocol distinguished by the Verified by Visa, MasterCard SecureCode, and American Express Safekey badges. 

Secure Electronic Commerce is an initiative whose basic principle is to guarantee security in Internet transactions. When making the payment through the secure payment gateway, the system will automatically verify that the credit card is activated for Secure Electronic Commerce. Next, you will connect with the issuing bank, which will request that you authorize the operation by means of a personal authentication code. The operation will only be carried out if the bank that issued the credit card confirms the authentication code. Otherwise, the transaction will be rejected. 

As a complementary measure to the ‘Secure Payment’ system and with the aim of collaborating in the prevention of fraud through the Internet, The Barclay Studio reserves the right to verify the personal data provided by the client as well as to adopt the measures it deems appropriate (including cancellation of the order) so that the purchased merchandise is delivered in accordance with the data contained in the order.

8.3. Value Added Tax

All the prices of the products that appear on this WEBSITE, Facebook, and Instagram include VAT at the rate in force at all times. In the deliveries made in the Canary Islands, Ceuta and Melilla, the corresponding taxes and duties will be applied in accordance with the regulations in force in each of these territories.

IX. SHIPPING AND DELIVERY

9.1 Shipping Policies and Procedures

Please review our shipping policies and procedures before placing orders for merchandise made available on this WEBSITE. We will not be liable for any loss, damage, cost, or expense related to delays in shipment or delivery of merchandise. The risk of loss of, and title to, all merchandise purchased on this WEBSITE will pass to you upon our delivery of that merchandise to the carrier selected to deliver it.

The Barclay Studio is based in Barcelona, Spain. We ship internationally throughout the world. Shipping and handling charges are based on the items purchased and the delivery region.

9.2 Production and Delivery Time

Delivery means the physical handing over of the Product to the customer (hereinafter the “Delivery”).

Products purchased on the WEBSITE can be delivered in SPAIN and abroad.

Shipping costs are based on weight, distance, and handling. We don’t make any profit on shipping, the price listed is either the actual cost or even slightly discounted.

  • Important! Each piece is made by hand on demand.  For this reason, in addition to the delivery time, you must add the manufacturing time which could be between two and four weeks depending on production.
  • Delivery time in Barcelona, please allow about 3-5 business days for your items to ship.
  • Delivery time period to rest of Spain, 4-7 business days for your items to ship.
  • International orders may take up to 10-15 business days depending on the region.
9.3 Shipping Cost

Shipping costs are based on weight, distance, and handling. We don’t make any profit on shipping, the price listed is either the actual cost or even slightly discounted.

The exact price of the transport will be calculated by including each item in the shopping bag and will be detailed on the page that summarizes the purchase before the customer confirms the order by clicking on the ‘Confirm payment’ button and before the introduction of the payment details. Shipping costs can be changed at any time without prior notice. Said change will be applicable from the moment the modification is included in these Conditions of Sale. In any case, those shipping costs that appear at the time of order will be valid.

9.4 Import Duties

Customers are responsible for all import duties and customs fees within their own country for international orders. The Barclay Studio is not able to predict or identify how long any order will take to arrive once it reaches customs in your specific country.

9.5 Delivery

To avoid incidents in the delivery (wrong addresses, inability to find someone at home, etc.), it is essential to correctly fill in the corresponding form.

Note that, it will not be possible to send orders to military bases or post office boxes.

The risk of the products will be borne by the customer from the moment of delivery. The shipment of the products purchased through the WEBSITE and Instagram will be made through a courier company and will be delivered within a period indicated on the WEBSITE according to the selected shipping method and, in any case, in the maximum term of thirty (30) calendar days from the date of receipt of the Confirmation.
